Representation of Liquidating Trustee Pursuing LBO Fraudulent Transfer Claims Against Bank

The United States Bankruptcy Court for the Middle District of Florida entered an order approving the retention of Mercer Law LLC—by the Liquidating Trustee of WestPort Holdings Tampa, L.P. et al.—to pursue fraudulent transfer and aiding and abetting breach of fiduciary duty claims against a bank for its predecessor’s funding of a leveraged buy out.  Such representation falls into the firm’s sweet spot given that it involves high-dollar insolvency litigation against a bank.  Unlike the vast majority of law firms, Mercer Law intentionally does not represent any banks.
