Often defense counsel will try to pressure plaintiffs’ counsel into taking low settlement offers by telling them that they “won’t be able to collect more than that.” We work with plaintiffs’ counsel in these cases to push back against these often baseless statements. Even if a defendant is insolvent or financially challenged, we work with plaintiffs’ counsel to find other potential sources of recovery including, but not limited to, directors and officers (as well as their insurers), private equity funds, hedge funds, and other major shareholders. While we are certainly prepared to be intelligently aggressive, we understand that we can often best serve our clients in these situations by remaining behind the scenes and assisting lead counsel in negotiating the most favorable consensual resolution.
